These Terms form a binding agreement between you and Tennessee Strong 2 LLC ("Tennessee Strong 2," "we," "us," or "our") governing the What Wine When mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy.
01
Eligibility
You must be at least 18 years old, or the age of majority where you live if higher, and legally capable of entering a binding agreement. The Service does not sell, deliver, distribute, or facilitate the purchase of alcohol. Any future fee will cover software features and services only. Drink responsibly and follow applicable law.
02
The Service
What Wine When helps organize a personal wine inventory and may provide label recognition, inventory and storage records, Prime Drinking Range and Estimated Peak information, Drinkability, Quality Fade Factor and Drink Tonight scores, tasting notes, pairings, estimated values, and confidence levels. Features may change, be limited, or be discontinued as the Service develops.
03
AI-Generated Information
The Service uses artificial intelligence and public sources. AI content is probabilistic and can be inaccurate, incomplete, inconsistent, or outdated.
- Wine identification may require review and correction.
- Drinking windows, maturity curves, peaks, and scores are estimates, not guarantees.
- Actual condition depends on provenance, storage, bottle variation, closure, transport, and other factors the Service may not know.
- Tasting notes and pairings are suggestions.
- Market values are not offers, appraisals, insurance valuations, tax advice, or investment advice.
- Confidence labels do not eliminate uncertainty.
You remain responsible for decisions based on the Service and should independently confirm information when accuracy is important.
04
Accounts and Security
Provide accurate information and keep it reasonably current. You are responsible for your credentials and activity under your account. Notify us if you suspect unauthorized access. We may require email confirmation, password reset, reauthentication, or other reasonable security measures. In-app account deletion is irreversible and is subject to the limited retention described in the Privacy Policy.
05
Your Content
Your Content includes label photographs, inventory information, notes, corrections, and storage descriptions. You retain ownership and grant Tennessee Strong 2 a limited, non-exclusive, worldwide license to host, copy, transmit, format, analyze, and display it as reasonably necessary to operate, secure, support, and improve the Service, comply with law, and enforce these Terms. The license ends when content is deleted except for permitted limited retention. You represent that you have the rights needed to submit it.
06
Acceptable Use
You may not:
- Break the law or violate another person's rights.
- Access another user's account, inventory, images, or data.
- Bypass authentication, access controls, rate limits, or security features.
- Introduce malicious code or disrupt the Service.
- Reverse engineer except where law expressly permits.
- Scrape, resell, sublicense, or commercially exploit the Service or generated database without permission.
- Submit unlawful, deceptive, infringing, abusive, or harmful content.
- Present AI estimates as certified appraisals or guaranteed values.
- Use the Service to facilitate unlawful alcohol sales or consumption.
07
Beta Service
During beta, the Service is under active development. Features may be unfinished, unavailable, or changed without notice, and data may need correction, reprocessing, or deletion before public launch. The Service is not a permanent archival or disaster-recovery system. Keep independent records of information that would be difficult to replace. Voluntary feedback may be used to improve the Service without payment, but we will not publicly identify you without permission.
08
Plans, Fees, and Renewals
The beta currently has no paid subscription terms. Before paid plans begin, we will disclose the price, billing interval, included features, renewal and cancellation terms, and any trial. Payments and refunds may be administered by the platform or provider disclosed before purchase. Automatically renewing subscriptions continue until canceled, and cancellation ordinarily stops future renewal without refunding the current period unless law or platform rules require otherwise.
09
Our Intellectual Property
The Service, software, design, branding, scoring presentation, and materials provided by Tennessee Strong 2 are owned by or licensed to Tennessee Strong 2 and protected by law. You receive a limited, personal, revocable, non-exclusive, non-transferable license for personal wine-inventory use. Wine names, labels, producer marks, and third-party content remain the property of their owners; appearance in the Service does not imply endorsement.
10
Third-Party Services
The Service relies on Supabase, OpenAI, Expo, Apple, future payment providers, and public websites. Their services may have separate terms, change, or become unavailable independently of us. Links and source references do not constitute endorsement.
11
Suspension and Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate access for material violations, security or legal risk, misuse, nonpayment of an applicable fee, or discontinuation. We will provide notice when reasonable, but immediate action may be necessary. Provisions that by nature should survive termination will survive.
12
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Tennessee Strong 2 disclaims express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment. We do not warrant uninterrupted, error-free, or secure operation, or the accuracy or suitability of any identification, drinking window, score, pairing, value, or other result. Some jurisdictions do not allow certain disclaimers.
13
Limitation of Liability
To the maximum extent permitted by law, Tennessee Strong 2 and its members, managers, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, revenue, data, or goodwill, or substitute-service costs arising from the Service. Total liability for all claims will not exceed the greater of the amount you paid during the 12 months before the event or US $100. Limits do not apply where prohibited by law.
14
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tennessee Strong 2 and its members, managers, officers, employees, and contractors from third-party claims and reasonable costs arising from unlawful misuse, a material violation of these Terms, or infringement by Your Content. This does not require indemnification for a party's own unlawful conduct.
15
Governing Law and Disputes
These Terms are governed by Tennessee law and applicable United States federal law, without regard to conflict-of-law rules. Mandatory consumer protections where you live continue to apply when they cannot be waived. Before filing a claim, both parties will make a good-faith effort to resolve it informally for at least 30 days after written notice. Any court proceeding not subject to a mandatory alternative forum will be brought in a state or federal court with appropriate jurisdiction in Tennessee, except where consumer law requires otherwise. These Terms do not currently require individual arbitration or waive class-action participation.
16
Changes
We may update the Service and these Terms. We will revise the last-updated date and provide additional notice when required. Material changes apply prospectively after any required notice period.
17
General Terms
If a provision is unenforceable, it will be modified to the minimum necessary extent or severed, and the remainder will continue. Failure to enforce is not a waiver. You may not assign these Terms without consent. We may assign them in connection with a merger, reorganization, asset sale, or operation of the Service. These Terms and the Privacy Policy form the agreement concerning the Service except for additional feature- or purchase-specific terms.
